PREVENTATIVE LAW

Just as you check your health to prevent illness in the future, have us prepare your legal documentation to prevent court action in the future.

BINDING FINANCIAL AGREEMENTS

  • Having us draw up a BFA or Co-Hab Agreement, can prevent a return to the Courts in the event your relationship does not work out. We are finding this a growth area and now seeing successful agreements being implemented without fuss or much cost upon the separation of those who saw the wisdom of preparing one during or before their relationship.

  • Organising and protecting your finances and assets with a Discretionary Family Trust is also a protective mechanism and may ensure that your assets remain in the family despite members re-partnering.

  • In the event you are not married but have separated from your partner, Termination Agreements are a viable option to expensive Supreme Court Litigation. They are necessary if you are tranferring real estate and wish to avoid payment of stamp duty. They also avoid the more expensive Supreme Court litigation.
